1. Acceptance of Terms
By accessing or using BinderBud ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
BinderBud is a Pokemon trading card collection tracking platform that allows users to:
- Browse and discover Pokemon cards across all sets and variants
- Track their Pokemon card collections and inventory
- Organise cards into customisable binders with visual display features
- View estimated market values for their cards
- Connect with other collectors through friend features
- Share need lists and respond to other collectors' needs
- Communicate with other users via direct messaging
3. Eligibility
You must be at least 16 years of age to use this Service. By using BinderBud, you represent and warrant that you are at least 16 years old. If you are under 18, you must have parental or guardian consent to use this Service.
4. User Accounts
To access certain features, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete registration information
5. Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose or in violation of any laws
- Harass, abuse, or harm other users
- Impersonate any person or entity
- Upload, share, or transmit content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
- Attempt to gain unauthorised access to any portion of the Service or other systems
- Interfere with or disrupt the Service or its infrastructure
- Use automated systems (bots, scrapers) without explicit permission
- Engage in commercial activities without authorisation
6. Trading Disclaimer
BinderBud is NOT a trading platform. We do not facilitate, mediate, or guarantee any trades between users.
The "Share Needed" feature and messaging system are provided solely to help collectors connect. Any trades arranged through BinderBud are:
- Conducted entirely at your own risk
- Between you and the other party, with no involvement from BinderBud
- Not guaranteed, insured, or protected by BinderBud in any way
BinderBud accepts no liability for lost packages, items received in different condition than described, scams or fraud by other users, disputes between users, or any financial losses resulting from trades.
We strongly recommend using secure payment methods with buyer protection for any monetary transactions.
7. Intellectual Property
Pokemon and all related trademarks, logos, and characters are the property of The Pokemon Company, Nintendo, and their affiliates. BinderBud is an unofficial fan project and is not affiliated with, endorsed by, or sponsored by these companies.
The BinderBud platform, design, and original content are protected by copyright and other intellectual property rights.
8. User Content
You retain ownership of content you submit to BinderBud (e.g., collection data, messages). By submitting content, you grant BinderBud a non-exclusive, worldwide, royalty-free licence to use, store, and display that content as necessary to provide the Service.
9. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
10. Copyright Concerns
If you believe content on BinderBud infringes your copyright, please contact us at [email protected] with details of the copyrighted work, the location of the infringing material, and your contact information.
11. Account Termination
We may suspend or terminate your account if you violate these Terms or engage in behaviour that we determine, in our sole discretion, to be harmful to other users or the Service.
You may delete your account at any time through the account settings. Upon deletion, your data will be handled as described in our Privacy Policy.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINDERBUD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
14. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
15. Changes to Terms
We may update these Terms from time to time. Significant changes will be communicated through the Service, and you will be asked to re-accept the updated Terms to continue using the Service.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts. If you are a consumer in the European Union, you retain any mandatory protections provided by the laws of your country of residence.
17. General
You agree to indemnify and hold harmless BinderBud from any claims, liabilities, damages, or expenses arising from your use of the Service or violation of these Terms.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BinderBud regarding the Service.
